Barley Mill Plaza plan found UNACCEPTABLE [for now]
 

The Stoltz Exploratory Plan for the Barley Mill Plaza site has been found unacceptable by our New Castle County Land Use Department professional planners.  I have appended the County Land Use Department’s 7/8/08 letter below.

The County Land Use Department letter states in part: “Upon completion and incorporation of the Exploratory Comments (June 19, 2008), you may submit a revised Exploratory Plan and appropriate fees to the Department of Land Use for review.”  Please carefully review the earlier June 19, 2008 referenced letter and other relevant documents at www.bobweiner.com.

The County’s rejection was based upon issues raised by our community at the July 1 Planning Board/Land Use Department Hearing, included compatibility with community scale and character, traffic related issues, drainage, noise and lighting.  Acting General Manager George Haggerty was very complimentary of Greenville citizens who testified noting that our comments were, for the most part, relevant and within the context of the applicable rules and regulations.

However, please be advised that the Stoltz organization will submit a new plan which may not be significantly distinguishable from the plan just found to be unacceptable. [Alternatively, the Stoltz organization could opt to challenge the regulatory ruling at this juncture or at a later time.]

While I am proud of our collective efforts, I must admonish everyone that we must remain constantly vigilant. I will continue to keep you apprised of all relevant actions. I promise to provide you with guidance and direction.

Dear Mr. Lober:

I am writing to you in reference to your Exploratory Plan submittal that is titled Barley Mill Plaza to the Department of Land Use and the Planning Board for review and comment.  As you are aware, this plan was furthered reviewed at the July 1, 2008 Planning Board Public Hearing.

As you are aware, issues raised at the hearing included compatibility with community scale and character, traffic related issues, drainage, noise and lighting.  The applicant should be prepared to respond to code compliance related issues as the plan proceeds through the review process.    Please note that the Exploratory Plan has been found unacceptable.  At this time these are the final comments of the Department of Land Use.  Upon completion and incorporation of the Exploratory Comments (June 19, 2008), you may submit a revised Exploratory Plan and appropriate fees to the Department of Land Use for review.
