The DEPARTMENT OF LAND USE AND PLANNING BOARD of New Castle County will hold a public hearing on Tuesday, June 7, 2011, in the Multi-Purpose Room of the Gilliam Building, 77 Reads Way, New Castle, DE, beginning at 7 p.m. to consider the following applications. The order in which the applications are listed is subject to change.
2008-0275-S/Z. North side Lancaster Pike (SR 48) and east side Centre Road (SR 141), Wilmington, DE. Preliminary Major Redevelopment Plan, Rezoning, and TAC Review for Barley Mill Plaza proposes to consolidate eleven parcels, to rezone a portion of the 92.07 acres, and to redevelop the site by removing 1,012,149 sf. of existing GFA and proposing 1,654,000 sf. of office and commercial GFA, with parking garages totaling an additional 1,255,656 sf. Ord. 11-050 will rezone 36.8 acres from OR (Office Regional) to CR (Commercial Regional). CD 3.
Considerations of rezonings may include zones other than those specified in the ordinances, and considerations for all other applications, including text amendments, may include changes other than those specified or requested in the proposals. Time limitations will be imposed on speakers. Information on all applications is available for public review in the Land Use Department, New Castle County Government Center, 87 Reads Way, Corporate Commons, New Castle, DE, from 8:00 A.M. to 4:00 P.M., Monday through Friday.
The public may submit written comments to the Department at any time if they wish to do so.
Here’s how it works:
An exploratory plan is submitted for a resubdivision.
The Department reviews it and sends comments to the applicant’s engineer. (This is where we are in the process.)
The engineer then addresses the Department comments and submits a record plan.
The Department reviews the record plan for compliance with our comments.
We then record the record resubdivision in the Recorder of Deeds.
Once the plan is approved by the Department and recorded, it is entirely up to the owner/applicant/developer when they want to implement the plan. If the question is about the phasing, it is up to the owner/developer which building they wish to construct. The phasing issue under consideration with this resub is merely to insure that adequate parking is provided when any building is constructed.
Understanding the Development Process
The Department of Land Use oversees the review of proposed development plans and rezoning applications to ensure that they meet legal requirements found in the following bodies of law:
· U. S. Constitution
· Delaware State Code
· N.C.C. Comprehensive Development Plan
· Unified Development Code (Chapter 40)
· Drainage Code (Chapter 12)
With input from State and other County agencies, staff review plans and rezoning applications for details and particulars relating to building lots, site drainage and water management, historic resources, transportation flow, sidewalks, transit access, fire safety, integration of utilities and other components. Protection of the site's natural resources is a high priority. Planners and engineers also encourage applicants to advance the best design possible.
